VELOCITY GAMES

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

PLEASE READ CAREFULLY. BY SIGNING THIS DOCUMENT, YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. THIS DOCUMENT MUST BE COMPLETED BY EACH PARTICIPANT OR LEGAL GUARDIAN OF A MINOR PRIOR TO PARTICIPATION.

 

1. DEFINITIONS

In this Agreement:

• “Velocity” refers to Velocity Games, its owners, operators, directors, officers, employees, volunteers, contractors, agents, successors, and assigns.
   

• “Activities” include but are not limited to Nerf battles, inflatable obstacle use, mobile party layouts, party games, physical challenges, or any other events organized by Velocity, whether indoors or outdoors, on public or private property.
   

• “Participant” means the person whose name appears below, or any minor(s) on whose behalf this document is being signed.
   

 

2. ASSUMPTION OF RISK

I acknowledge and understand that participation in the Activities involves physical exertion and inherent risks, including but not limited to:

• Being struck by foam darts or equipment;
   

• Trips, slips, and falls on natural or artificial surfaces;
   

• Collisions with other participants or inflatable barriers;
   

• Equipment malfunction or improper use;
   

• Exposure to outdoor elements and airborne allergens;
   

• Potential transmission of illness, including viral or bacterial infections.
   

I voluntarily assume all such risks, whether foreseen or unforeseen, and accept full responsibility for any resulting injury, illness, death, or property damage.

 

3. RELEASE OF LIABILITY & WAIVER OF CLAIMS

In consideration of Velocity permitting the Participant to take part in the Activities, I, on behalf of myself, my child(ren), or any minors for whom I am responsible, hereby:

• WAIVE any and all claims I may now or in the future have against Velocity;
   

• RELEASE Velocity from any and all liability for any injury, loss, or damage resulting from participation in the Activities, including claims arising from negligence;
   

• AGREE NOT TO SUE Velocity for any claims related to the Activities;
   

• ACKNOWLEDGE that this release is binding upon me, my heirs, executors, administrators, and assigns.
   

 

4. INDEMNITY AGREEMENT

I agree to indemnify, hold harmless, and defend Velocity from and against any and all claims, actions, causes of action, losses, liabilities, damages, costs (including legal fees), or expenses arising out of or related to:

• My participation or the participation of any minor in the Activities;
   

• Any property damage or personal injury caused by me or the minor;
   

• Any breach of this agreement.
   

 

5. EQUIPMENT AND PROPERTY

I understand and agree that:

• Any equipment loaned to me or my child(ren) by Velocity must be returned in good condition.
   

• I am responsible for any loss, damage, or misuse of equipment beyond reasonable wear and tear.
   

 

6. HEALTH AND SAFETY DECLARATION

I declare that:

• I (or the participating minor) am in good health and physically able to participate.
   

• I will inform Velocity of any medical, physical, or behavioral condition that may affect safe participation.
   

• I understand that Velocity reserves the right to remove any participant for unsafe behavior or violation of rules.
   

 

7. MEDIA CONSENT

I grant Velocity permission to use photographs and/or videos of myself or my child taken during the Activities for promotional, marketing, or educational purposes, including use on websites and social media. I waive any rights to compensation or approval related to these materials.

 

8. ELECTRONIC COMMUNICATION AND SIGNATURE

I consent to receive email communication from Velocity about upcoming events, promotions, or changes. I understand I may unsubscribe at any time. I also agree that my electronic signature has the same legal effect as a handwritten signature.

 

9. SEVERABILITY & GOVERNING LAW

If any part of this agreement is found to be invalid or unenforceable, the remaining provisions remain in full force and effect. This agreement is governed by the laws of the Province of [Your Province], Canada.

 

ACKNOWLEDGEMENT AND ACCEPTANCE

I have read and fully understand this Release of Liability, Waiver of Claims, Assumption of Risk, and Indemnity Agreement. I understand that by signing it, I am giving up substantial legal rights and do so freely and voluntarily.
